Blogs: a new balance of power between big media and individuals?

Blogger Spocko, a media critic, saw his blog be shut down by his internet service provider after The Walt Disney Company complained about, officially, illegal use of copyrighted content. But there’s more to it than that: it’s a first insight into the new media balance of power.

Big media still crush smaller outsiders, but at least the emergence of blogs gives a voice to those small-timers, and even allows for other media sources to pick up on those isolated events and make them known.

To make long things short: Spocko had launched a propaganda campaign against an ABC-affiliated radio station (KSFO), condemning its hate-filled content. Spocko sent letters to detract advertisers, referring to his blog for proof, where he posted audio clips of the talk shows. As a result, advertisers fled and Disney shut down Spocko's website, after warning him unsuccessfully to remove the material.

Neil Simpkins, spokesperson for Spocko’s internet service provider, 1&1, explained:

"The [fair use] battle for bloggers hasn't been waged yet," Simpkins said. "Right now, technology is outracing the legal system."

Spocko “says the company is particularly leery of the audio files, adding that 1&1 would "probably be more than likely" to allow the blog back if Spocko used transcripts of the show as opposed to actual audio files of what aired,” Online Media reported.

An intriguing observation considering Disney’s controversial past with subliminal audio messages.

But the real point to this story is that, although Disney might seem to have the corporate upper hand – which it does – a single blogger was able to bring out news by himself on a large scale. While Spocko’s website might be shut down, many big companies have retracted their ad contracts with the radio station, and news sources have picked up on this small incident.

The Spocko vs. Disney affair should also prompt legislative bodies to keep a closer eye on the evolution of technology and according legislature.
